Do braces prevent the validity of ghusl

Question:

Asslamu alaikum, recently I have put dental braces on my teeth with clips glued to my teeth. Is my obligatory ghusl valid with this?

Answer:

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

A valid ritual bath [ghusl] is: 1) the intention and 2) bathing the entire [outer] body. Washing the mouth is not obligatory. (Mughni al-Muhtaj v. 1, p. 219; Nihayat al-Muhtaj v. 1, p. 225) Therefore, wearing braces would not affect the validity of one’s ghusl.

The Ruling on Saying the Basmala in Wudu

Question: What is the ruling on saying “Bismillah – With Allah’s name” when performing wudu’ (ritual ablution)? What of the narrations used by the Hanbalis to state it is obligatory?

 

Answer:

Alhamdulillah – Allah praise and thanks is to Allah who gives us the ability to worship Him! Peace and blessings be upon Him and His family, and followers!

Imam An-Nawawi (rahmatullah ‘alayh) states in his Minhaj,

“[and it is sunnah to say] The Tasmiyah (i.e. ‘bismillah‘) at the beginning [of wudu']…”

In his At-Tahqiq he states, “The tasmiyah is recommended (mandub) at the beginning of wudu’…”1

The proof for it being recommended is that the Prophet Muhammad (sallallahu ‘alayhi wa sallam) performed wudu’ saying Bismillah at the beginning.

Nail Polish prevents Wudu and Ghusl

Asaalam alaykum..A Sister asked me what is the fiqh of wudu related to nail polish. She wanted to know if she can have nail polish on and make wudu.

Answer:

Taken from “Reliance of the Traveller” (Translation of ‘Umdat As-Salik by Shaykh Nuh Keller):

“If dirt under the nails prevents the water (O: of ablution or the purificatory bath from reaching the skin beneath) then the ablution (Shaykh ‘Umar Barakat: or bath) is not valid. (Shaykh Nuh ‘Ali Salman: The same is true of waterproof glue, paint, nail polish, and so forth on the nails or skin: if it prevents water from reaching any part of the nails or skin, no matter how small, one’s ablution or purificatory bath is not valid.)” [e5.26]

A Man Washing His Wife's Deceased Body for Janazah

Question:

Assalamu Alikum Sheikh,

If husband is Ghair Mahram [i.e. here a marriageable mahram] to his wife how can the husband perform the ritual bath (ghusl) to his dead wife, will it not nullify the wudhu of the deceased wife?

Answer:

Wa’alaykum Salam wa Rahmatullah,

It is permissible for a husband to perform the ghusl/bath of his dead wife. [Nihayat Al-Muhtaj ila Sharhil Minhaj Vol. 2 page 449 of Shams-ud-din Muhammad ibn Abil - 'Abbas, also Al-Majmu' of Imam An-Nawawi Vol 6 page 200, and elsewhere.]

Regarding the wudu’ of the deceased wife, then it will not be nullified, and therefore it will remain valid. [Rawdat At Talibin Vol. 2 page 102 of An-Nawawi].

Clipping the Nails While in Major Ritual Impurity

Question:

Dimyati Bakri mentions a text that that says that a person’s fingernails, hair and blood return to them in the hereafter, therefore, one should not cut one’s nails or cut one’s hair in a state of janabah because these body parts with return in the hereafter in janabah. This is mentioned without citing any evidence, is there something authentically established in the hadith for it?

 

Answer:

Wa alaykum salam wa rahmatuLlah,

Abu Bakr Shata al-Dimyati related the mentioned text in the work Hashiyat I’anat al-Talibin ‘ala Hill Alfaz Fath al-Mu’in li Sharh Qurrat al-‘Ayn bi Muhimmat al-Din. As well, both Ramli and Khatib related it verbatim from Imam Ghazzali’s Ihya’. (Nihayat al-Muhtaj 1/229; Mughni al-Muhtaj 1/125) This report from Ghazzali is also found in Qalyubi’s commentary; however, he criticized it, and stated,

“For things such as blood returning, that is problematic; as are other body parts, because what returns are the body parts that one died with…” (Hashiyat al-Qalyubi 1/68)

Bujayrimi related this from him with slight rephrasing; and also, something similar from Madabighi. (Tuhfat al-Habib 1/364) Accordingly, some have stated it, while others objected to it.

Is it Sunnah or Good Adab to Face the Qiblah When Making Wudu?

Question: Is it sunnah or adab to perform ablution while facing the qibla? I have read many shafi fiqh books and in some books it is adab and in some books it is sunnah (if it is sunnah please reply with a proof)

 

Answer:

Facing the direction of prayer in ablution is recommended in the Shafi’i school (al-Majmu‘:1:189, Mughni al-Muhtaj: 1:107) Some of our jurist, such as al-Shirbini, classified this act as a sunnah, while others, such as Ibn Naqib al-Misri (‘Umdat al-Salik) and Ahmad ibn Rislan (Zubad. 77), considered it to be an adab (proper etiquette).
